The process of registering the society is done by filing an application with the Registrar of Societies at the state level and with the Registrar of Companies at the national level.

Registration of a Society In India

  1. The incorporation of a society is the first step to forming a society. The societies are formed under the Societies Registration Act 1860 (Act 15 of 1860). The registration of societies under this Act is mandatory.
  2. A society can be registered either as an association or as a company at the option of its promoters. A company cannot be registered as an association under this Act.
  3. Any seven persons may form an association by subscribing their names to the memorandum and articles of association of the proposed society, which shall be drafted in accordance with the rules framed by the Central Government in this regard and signed by them in token of their consent thereto and thereafter they shall apply for registration to Registrar concerned under Section 3A(1) of the Act within thirty days from such subscription.
